BUT JHA CONTINUES...
After the RPV Planning Commission denied Mr. Jha’s appeal of the City’s determination that he did not qualify either for an exemption from all zoning rules (Builder’s Remedy Law) or an expedited review of his project, including an exemption from environmental laws, (SB 35/423 Law) he has again appealed to get these entitlements approved.
This time he will go in front of the City Council to ask for the same two above entitlements.
The City Council meeting has not yet been scheduled, but is anticipated to be held in January of next year.
We need to have the same awesome turnout at the City Council meeting that we had at the Planning Commission meeting (See picture below). Thanks to everyone who came and wore red! There was a sea of red at the meeting, with many of us either speaking live, or recording messages to be played at the meeting. In addition, there were 61 letters opposing the project, which is amazing!
Our voices are being heard, and we need to continue to ensure that they are heard when this issue comes in front of the City Council.
If the City Council also denies his appeal, the only way for Jha to continue this project is to sue the city at great time and expense. Without at least the Builder's Remedy entitlement, he can’t build this project. And until the city (or the court) agrees that he’s entitled, he can’t begin the project review process with the city.
As we get a firm date for the City Council meeting, we will let everyone know.
