Update #16 - Developer Makes Big Error
Big news – Rancho Palos Verdes' Housing Element was placed “in compliance“ by the Department of Housing and Community Development as of June 12th .
What does this mean? It means that no new Builder's Remedy project applications can be submitted for the city. All existing builders remedy projects can however continue. This would include the Silver Spur Canyon project.
HOWEVER - we are only safe from new projects for about a year, because the state will review RPV‘s progress on completing its requirements under the Housing Element annually, and if the state determines that the city has not made enough progress, it can decertify our housing element and any home or vacant land for sale is vulnerable to a Builder's Remedy apartment or condominium development.
Other BIG NEWS
The developer that submitted the application for the 482 condominium complex in Silver Spur Canyon made a significant error on the application, inadvertently omitting approximately 500,000 square feet of construction that would go toward parking. The city has now told the developer that their application is no longer valid.
Does that mean the Silver Spur Canyon project is dead? Not necessarily but it could represent a big and significant new hurdle for the developer. The developer could take the city to court over this determination, and if so, it would be more time and cost for the developer. We should know more by the developer's deadline for the final design of the project, which must be submitted to the city by mid-July. We expect to get some more information on communications between the city and the Developer within the next couple of days/weeks through a public records act request and will share that with you as it becomes available.
Via Colinita Project
The other Builder's Remedy project in RPV, located in the Miraleste area on Via Colonita, is on hold as the sale of the property to the developer has fallen out of escrow and it is back on the market. It’s not clear why it fell out of escrow at this point. The city has expressed some interest in buying it.
